Scope of these Conditions of Use

These Conditions of Use govern the relationship established between users and Mazda Motor Europe GmbH, Hitdorfer Straße 73, 51371 Leverkusen, Germany (hereafter called “Mazda Motor Europe”) regarding the information provided by Mazda Motor Europe via the Internet portal http://www.mazda-press.com (hereafter called “Mazda Press Portal”).

Use of the Mazda Press Portal is only allowed on the basis of these Conditions of Use. Use of the Mazda Press Portal requires the user to have access authorisation.

Mazda Motor Europe reserves the right to amend, supplement or replace these Conditions of Use at any time.

Registration and Use

Upon log-in or registration, the user is given a user name and password. The user must keep the user name and password strictly confidential and ensure that unauthorised persons never gain access to them.

The details requested upon registration must be provided by the user accurately and in full. If the details given by the user change after the initial registration, the user agrees to correct or update the information immediately in his user field.

By logging in or registering, the user agrees that these Conditions of Use are applicable in their latest version. The user confirms his agreement by clicking on the box provided on the registration page.

Due to the nature of the Internet and computer systems, Mazda Motor Europe cannot guarantee uninterrupted availability of this Mazda Press Portal. Mazda Motor Europe also reserves the right to suspend or restrict operation, or provision of all or part of, the Mazda Press Portal without notice at any time.

Rights to the Mazda Press Portal

This Mazda Press Portal contains data and information of all kinds which is protected by law.

The user may use and download the information it contains for journalistic purposes. Warranty and Liability

Mazda Motor Europe does not guarantee that this Mazda Press Portal will be accessible and trouble-free at all times. This applies in particular if access to the Mazda Press Portal is affected by problems beyond the control of Mazda Motor Europe. Mazda Motor Europe will, however, endeavour to correct access problems without delay, as far as technically and operationally possible.

Mazda Motor Europe bears unlimited liability for loss or damage caused by access to, or use of, the Mazda Press Portal or individual contents if caused by premeditation or gross negligence on the part of Mazda Motor Europe or a legal representative or agent of Mazda Motor Europe. This also applies to damages resulting from fatality, fatal injury, physical injury or harm to health.

Liability for damage due to negligent breach of essential contractual obligations by Mazda Motor Europe or a legal representative or agent of Mazda Motor Europe is limited to the typically foreseeable loss. Further liability by Mazda Motor Europe, particularly for damage due to simple negligence in breach of non-essential contractual obligations, is excluded.

The foregoing liability exclusions and limitations do not apply, if Mazda Motor Europe has given guarantees and/or acted with malice aforethought in connection with use of the Mazda Press Portal.

Mazda Motor Europe’s liability under product liability legislation is not affected by the foregoing provisions.

Barring of Access, Cancellation, Deletion of Accounts

The right of use is granted for an indefinite period and may be duly cancelled by the user or by Mazda Motor Europe at any time.

Notice of cancellation must be given by letter or e-mail.

Final Provisions

The basic right of use is governed solely by the laws of the Federal Republic of Germany. Application of international and/or UN conventions is expressly excluded.

The legal venue for all disputes arising out of, or in connection with, the basic right of use and/or these Conditions of Use is the court with local jurisdiction over the headquarters of Mazda Motor Europe, if the user is a trader or a legal entity or credit institution governed by public law. Court rules on exclusive responsibilities remain unaffected.
